Statement of intent. The intent of the following regulations is to serve the best interest of the health, safety, prosperity and welfare of the citizens of DeLand by:
33-35.02 Responsibility of owner. Every owner of a property within a designated Historic District shall keep in good repair
All of the exterior portions of such buildings or structures;
All interior portions thereof which, if not so maintained, may cause such buildings or structures to deteriorate or to become damaged or otherwise fall into a state of disrepair; and
In addition, where the historic resource is an archaeological site, the owner shall be required to maintain his property in such a manner as not to adversely affect the archaeological integrity of the site.
33-35.03. Determining neglect. In the event the board determines that a property with a designated Historic District or a designated historic resources is in the course of being "demolished by neglect," the board shall notify the owner of record of such preliminary findings, stating the reasons therefore. The board shall request a meeting with the owner or the tenant of the building that is not being adequately maintained, and the board shall present ways to improve the condition of the property. If the owner or tenant fails to take action the board may notify the building official to institute proceedings before the City of DeLand Code Enforcement Board under the authority of applicable laws and regulations.
33-35.04 Notification and enforcement. Where the board determines that properties within a designated Historic District or designated historic resource lack maintenance and repair to such an extent as to detract from the desirable character of the Historic District or historic resource, the board shall request a meeting with the owner or tenant of the property that is not being adequately maintained, and the board shall present ways to improve the condition of the property. If the owner or tenant fails to take action, the board may notify the building official to institute proceedings before the City of DeLand Code Enforcement Board under authority of applicable laws and regulations.
33-35.05 Emergency conditions applicable to this section. The building official shall immediately notify the historic resources coordinator of cases where there are emergency conditions dangerous to life, health or property affecting a building or structure in a designated Historic District, a designated historic building or structure, or a building or structure over 50 years old. Notification to Historic Resources Coordinator shall consist of a report from a building code inspector describing the dangerous conditions and any other documentation that the historic resources coordinator shall require in order to prepare a report, oral or written, to present to the DeLand Historical Preservation Advisory Board. After consultation with the historic resources coordinator, the chief building official may order the remedying of the dangerous conditions without approval of the board.
